Sixteen states, including Florida, are suing the U.S. Department of Homeland Security (DHS), Secretary Alejandro Mayorkas, and Biden Administration officials over its alleged unlawful parole in place policy. The parole in place policy permits certain spouses of United States citizens to apply for parole in place without leaving the country. If their application is successful, they will be eligible to apply for legal permanent resident status.
Federal statute requires that undocumented immigrants must depart from the United States and be admitted legally before obtaining immigration benefits, like permanent resident status. The lawsuit argues that the parole in place policy directly violates the laws that Congress created restricting parole in place. Stating that the policy ignores the United States Constitution, Attorney General Paxton has asked the court to grant injunctive relief to halt the policy while there is an ongoing trial.
