The Specialty Occupation

A "specialty occupation" is one that requires the "practical and theoretical application of a body of really competent and student knowledge to perform and conduct the work or occupation," as specified by the H-1B regulations. Also, in order for a job offer on an H1B visa to qualify as a "specialty occupation," it must fulfill one of the following conditions:

• A bachelor's degree or the equivalent of a bachelor's degree is required;
• The requirement of a bachelor's degree or higher in the industry closely related to the work is not uncommon.
• The employer may demonstrate that the position is necessary or difficult.
