Here are some important points that you should remember about the H2B visa process:

• A non-US citizen can’t apply for an H2B visa on his or her own. There should be a U employer that should sponsor them.
• The employer should obtain a prevailing determination.
• The employer should apply for the temporary labor certification and complete the recruitment process.
• Once the recruitment is completed, the employer should file a petition for H2B temporary worker visa which should include the valid temporary nonagricultural labor certification and evidence that the foreign employee meets the minimum job requirements.
• Application for the H2B visa should then be filed at the US consulate.
