The Conditions in Same-Sex Divorce
In LGBTQ divorce, there are notable circumstances that the spouses must prove before the court. These are usually the following:
- The need not to live separately to be declared ‘separated;
- The existence of a malfunctioning relationship;
- The satisfaction of 12-month period;
- The actual issuance of decree of separation;
- The term and permanent separation of the divorcing couple;
- The declaration that the parties have been separated for a minimum of 12 months;
- The separation period of at least 12 months
